moldova-flagThe main legislative document of Republic Moldova in field of maritime law is the Merchant Maritime Code, in force from 30.09.1999.
Besides a lot of specific regulations for maritime law, the code regulates also the procedure and conditions for registration of a ship under the flag of the Republic of Moldova. In this article will be presented basic provisions related to the right of navigation under the flag of the Republic of Moldova, the appearance of this right, procedure and conditions of ship registration, and finally, termination of the right to sail under the flag of Moldova and deletion of vessel from Register of ships.

The right of navigation under Republic of Moldova flag
The right of navigation Moldovan flag is granted to ships that are recorded in the register of ships and which:
a) owned by individuals and legal entities of the Republic of Moldova;
b) owned by foreign individuals and legal entities;
c) operated under a bareboat charter or a leasing contract.
Ship Registration in the State Register of Ships of the Republic of Moldova is performed by the public institution “Harbor Master Giurgiulesti”.

Appearance of the right of navigation under the Republic of Moldova flag
The right of the ship to navigate under the flag of the Republic of Moldova occurs from the moment of its registration in the Register of ships or Naval catalog.
Shipowners and charterers that have registered their vessels in the ship’s registry shall be exempt from taxes and customs duties in accordance with applicable Moldovan law.
The ship purchased or built in another country receives the right to navigate under the flag of the Republic of Moldova at the time of issuance of a provisional certificate attesting that right, by the Consul of the Republic of Moldova.
This certificate is valid until the ship will be registered in Ship registry or in the Naval catalog, but not more than one year.
The vessel, which enjoys the right to sail under the flag of the Republic of Moldova has the nationality of the state and is obliged to fly only the national flag of the Republic of Moldova.

State registration of vessels
Vessels of the Republic of Moldova that are supervised by the classification societies recognized by the Government of the Republic of Moldova are registered in the State Register of Ships. List of classification societies recognized by the Republic of Moldova can be found here.
Vessels of the Republic of Moldova which are not liable to registration in the State Register of Ships shall be recorded in the naval catalog.
At the request of freighter, ship, chartered by bareboat charter, may be registered provisionally (for a period not exceeding the term of the bareboat charter) in the State Register of Ships or in naval catalog, if at the time of chartering:
a) is not registered in the Register of ships of another State;
b) are registered in the ship’s registry of another state, but the right to fly the flag of that state was suspended, fact, that must be confirmed by shipowner, wich will submit the appropriate certificate.

The conditions of registration
The vessel must be registered in the Register of Ships or in Naval catalog in just one seaport of the Republic of Moldova.

Deletion of vessel
The vessel is deleted from the Register of ships or Naval catalog if:
a) cannot be operated and repaired;
b) lost the right to navigate under the flag of the Republic of Moldova;
c) was lost or wrecked.
Republic of Moldova does not recognize the registration of its vessels in the Ship register of another state, if the vessel wasn’t deleted, as established, from the Register of ships or Naval catalog of Moldova.
The vessel, registered in the Register of ships of a foreign state may be registered in the Moldova’s Register of Ships or in Naval catalog after exclusion from the register of foreign states and representations of proofs that certifying this.
