branch officeIn accordance with national legislation, non-resident enterprises, their associations and international organizations have the right to establish affiliates and trade-economical representative offices in the Republic of Moldova.
Affiliates of non-resident enterprises, their associations and international organizations established in Moldova acquire the status of an enterprise which completely belongs to a foreign investor from the date of their registration in the Republic of Moldova.
Affiliates of non-resident enterprises are registered in Moldova in accordance with applicable law, but without status of legal entity and the without the right to conduct economic activity.
The enterprises with foreign investment may establish affiliates and trade-economical representative offices in the Republic of Moldova and beyond its borders if it is provided by the constituent documents of the enterprise.
Branches and subsidiaries established in Moldova by resident enterprises with foreign investment are not legal entities.

Registration of affiliates and trade-economical representative offices.
Affiliates and trade-economical representative offices are registered on condition to indicate in the constitutional documents information about their creation, their name and registered office.
Affiliates and trade-economical representative offices are registered without attribution of legal entity status. The procedure for registration of affiliates and trade-economical representative offices of foreign legal entities is similar to the procedure of registration of national legal persons.
For the registration of affiliates and trade-economical representative offices shall be submitted the following documents:
a) the application for registration, in the form approved by the state registration body;
b) decision of the competent authority of legal entity, which will contain data on the creation of a branch or representative office, on the approval of its regulations and on the appointment of the administrator;
c) the regulation document of a branch or representative office (in duplicate);
d) the approval of National Bank of Moldova – for branches and subsidiaries of financial institutions;
e) the approval of the National Commission of Financial Market – for the savings and loan associations.
